Texas Dad on trial accused of killing drunk driver

    I would have done the same if I drunk driver killed my kids.

    That is a tough call for anybody but the father claims that he didn't do it..we will see what happens but once again if it was me..:dontknow:

    What happen is their car broke down his sons and him were pushing car ,two boy were pushing from behind he was pushing at drivers door and steering,
    They were 50 or 60 yards from their house when the drunk driver slammed in the rearend off the car (They claim at over 60 mph).And one of the boys was cut in half from the impact.
    He(drunk) was half stumbling out of car when the Dad freaked out and COPs say he ran to his house and came back and blasted the guy .No gun was found ,no witnesses ,he has never said he did it .He will not be found guilty in Texas trust me .He should be awarded Father of the Year IMHO.

    A Texas father was found not guilty Wednesday of gunning down the man who killed his young sons in a drunken-driving accident. It took the jury three hours to acquit David Barajas, who was charged in the shooting death of 20-year-old Jose Banda Jr. in December 2012.

    Police said an intoxicated Banda struck Barajas and his two children while they pushed the family’s disabled truck down a road, just 50 yards away from their home in Alvin, south of Houston. Barajas’ children — David, 12, and Caleb, 11 — were killed.

    Amid the chaos, authorities charged, Barajas went home, retrieved a gun and went back to the wreckage to shoot Banda in the head. But investigators never recovered a gun and didn't have an eyewitness to the shooting.

    Barajas’ attorney, Sam Cammack, said his client’s only focus the night of the crash was trying to save his sons’ lives. Barajas would have faced up to life in prison if convicted.
