Update, I just got an email back from our Police Chief, he advised me that the driver (the 16y/o) was found guilty of the traffic violation.

Arizona Revised Statutes : 28-701A.

28-701. Reasonable and prudent speed; prima facie evidence; exceptions
A. A person shall not drive a vehicle on a highway at a speed greater than is reasonable and prudent under the circumstances, conditions and actual and potential hazards then existing. A person shall control the speed of a vehicle as necessary to avoid colliding with any object, person, vehicle or other conveyance on, entering or adjacent to the highway in compliance with legal requirements and the duty of all persons to exercise reasonable care for the protection of others.

Good to hear that! Now, on to the lawsuit if they dont pay up!

I think that when it goes to trial and gets heard in front of a jury, it will be an open and shut deal.... there is so much evidence against her...

First off, Scott I hope this works out in your favor, which I have every confidence that it will.

Second, this whole thing puts me in friggin orbit. When I was a kid when we screwed up we had no choice but to own up to it and take our medcine, or face a pissed off old man that was gonna beat you with a belt. Nowadays we teach our brats that you try everything in the world to get out of taking responsibility and to game the system to your advantage even if it means lying your ass off. This is what's wrong with society (at least one of the many things) we just don't teach our kids the right values any more...what a shame.

Yup............why cant people take responsibility for themselves anymore? Its such BS!!! Sorry about the back pain and hassles you have been enduring Scott. Sucks!!! Keep us updated. We will all toss back a cold one the day you post you have won and collected!!

Exactly... its never been about the money, its more about the principal behind the issue... granted me having to deal with the issues is worth something, the money has never been my focus.

Glad its working out for you Scott.

Total BS IMO.... Like people dont have enough to deal with already everyday...

Looks like you are on a roll lately... Paxton next!!!!

Yeah.. tell me about it.. Paxtons hearing was 3/17, still have not heard what the outcome is.. the judge wanted time to review the case, and information.

Get this... during the hearing... Middlebrook (Paxtons owner), called me a "Cyber Extortionist" in front of the judge... I was totally polite to him during the hearing...

Another new developement today in this case... get this.

This family of the girl filed a complaint against the officer that cited her, and who subseqently showed up in court, where she was found guilty/responsible.

So, today.. I get a phone call from Internal Affairs, asking for clarification on the situation, and told me "statement" once again.

I could almost hear it in his voice, as if to stay... "why am I even talking to him, she rearends him, gets cited for it, goes to court and loses, and now is unhappy with the situation"

I just cant believe Allstate still wants to claim "her innocence" with all of this going against her.. but hey.. the longer they drag it out, the more my attorney will demand for me "having to deal with it all"

Its so stupid, that people today just can not admit their responsibility and accept it for what it is...

Interesting development. Is your atty holdong on payment (contingency) or you fronting the cash?
The attys are still negotiating? Timeframe to ending 3-6 months?

Its on contingency. They dont get paid unless I get paid. I would guess 3-6 months to the end.

Scott.

Allstate does suck!

I Fired Allstate after 30+ years and went with amica( $600.00 Less.),
and now they are giving me a runaround about refunding my premium.

Progresive is worse, I had a car stolen, recovered with a blown engine. To get them to pay i had to threatin to come to cali and kick every mother f'ers ass there until i got my money. Next day 3,100 check in the mail........................

told them they'd have 300 pounds of pure hate waiting on their doorstep :)

I'm kind of surprised that you're surprised. Allstate is defending their customer and of course they don't want to pay.

Good Luck.

Right..... I understand that.... but the odds are stacked against her.. and hey.. the longer they hold and drag things out.. means the larger my settlement will be.

Scott, keep dragging it out brotha. I didnt get a chance to scroll through what everyone has wrote, but I hope they have wrote something similar. I was hit 2 years ago (well in May it will be two years), and I'm still working the litigation. Different situation (woman dropped a couch on the freeway, I avoided it, and ended up flipping the median). The insurance companies are doing the same thing. If you have good lawyers, they will corner them. No worries. Just take care of yourself, and stay healthy.
