Ohio's highest court has ruled that a person may be convicted of speeding purely if it looked to a police officer that the motorist was going too fast.

The Ohio Supreme Court ruled Wednesday that an officer's visual estimation of speed is enough to support a conviction if the officer is trained, certified by a training academy, and experienced in watching for speeders. The court's 5-1 decision says independent verification of a driver's speed is not necessary.

The court upheld a lower court's ruling against a driver who challenged a speeding conviction that had been based on testimony from police officer in Copley, 25 miles south of Cleveland. The officer said it appeared to him that the man was driving too fast.

It's been that way here in NJ as long as i've been an officer...New officers are trained to estimate a vehicle's speed to within 4 mph upon observation of the vehicle.

In a narrowly split decision, the Supreme Court's conservative majority expanded its limits on the famous Miranda rights for criminal suspects on Tuesday - over the dissent of new Justice Sonia Sotomayor, who said the ruling turned Americans' rights of protection from police abuse "upside down." Justice Anthony Kennedy, who wrote the majority opinion, said a suspect who goes ahead and talks to police after being informed he doesn't have to has waived his right to remain silent. Elena Kagan, who has been nominated by President Barack Obama to join the court, sided with the police as U.S. solicitor general when the case came before the court. She would replace Justice John Paul Stevens, one of the dissenters.

A right to remain silent and a right to a lawyer are at the top of the warnings that police recite to suspects during arrests and interrogations. But Tuesday's majority said that suspects must break their silence and tell police they are going to remain quiet to stop an interrogation, just as they must tell police that they want a lawyer.

This decision means that police can keep shooting questions at a suspect who refuses to talk as long as they want in hopes that the person will crack and give them some information, said Richard Friedman, a University of Michigan law professor
 
I've had multiple go to trial...none of which turned out well for the defendant. The judge, however, does take the 4mph off the speed that is on the summons. 50 in a 25 becomes 46 in 25.

Nice! There are always ways out...but i keep my stuff in order (certs, training etc) but if you know the system well enough, or get a certain judge, it can go away...I don't write many tickets in that manner, but it is possible.
 
Thats why they call it the Browneye state instead of the buckeye state;)

I had a cop try that with me once, and the judge threw it out. visual estimation is not proof of speeding.

If I lived in a state like that, I'd do like SRTBrad does and keep a video camera rolling when I'm driving!
 
Did the court specify training, certification and experience requirements, including minimum standards and time periods/requirements for retraining and recerts? This seems to be a subjective ruling if these requirements aren't defined by law.

Yep, Bob it has been that way in NC for many years. I actually got a ticket and it said "I approximated his speed at 50 ina 35. Nothing I could do except be pissed!

The whole idea reminds me of the guy at the carnival that guesses your weight or age heheh.

I really don't understand how in this day and age it is considered to be a reliable way to judge speed. There are plenty of tools at their disposal to measure the speed of a vehicle.
