Joanne got one and had to spend 5 weekends in the poky!LOLOL

And she got ballsy on the last weekend and drove herself down!, called me to come get the car, she pitched the keys over the fence and almost got me and jail and her a few more weeks!LOLOLOL
 
My daughter got caught this summer driving after curfew time. THe officer figured if she was out this late she had to be drinking or on dope. SHe refused the breath test so he took her right to the hospital for a blood test. THe hospital found everything to be .0000 , nothing illiegal in her system what so ever. THe cop freaked out at the hospital when he found this out and had to be restrained by hospital staff. Seems officers here get a big spiff from our state if they catch under age drinkers. He spent 2 hours knowing he was going to get a big pay day and it all turned bad. He still went ahead and charged her with DWI even though he knew it was impossible based on the blood tests. He also stated that she tried to elude him at speeds over 120 miles per hour. Her car is speed limited at 85 mph. I had to spend a bunch of money to get it all cleared up. SHe was guilty of the curfew violation and paid the price for that but did not have to pay for the stuff she did not do. I used to think the cops were all good folks but I now know there not all so honest.
 
It sucks to have to deal with power tripper cop like that. You should have called a lawyer and started a suit against that dick cop and the police department.
 
While I have no tolerance for people who drive under the influence, it's people that make the enforcement system suck.

My daughter is a criminal defense lawyer (yup, a flaming liberal) and tells her clients to never agree to any of the field tests if you are told that there is a suspicion that you are "under the influence". The statistics say you are going to jail guilty or not that evening...there is no sense in making it impossible for the lawyers to defend you.

Also it seems to me that it is not the police officer that charges you, it is a state attorney that has to be convinced by the officer that you are guilty...so there is often more than one person involved in the pushing of a poor or weak case...

That is not such great advice. You start arguing with a cop on the side of the road you are most likely going to have more problems than drunk driving. If you are caught it is best to do what you are told and deal with it in court, not try to talk yourself out of trouble when you're half in the bag.

Ill agree with you Prof i personally would not agree to any field test's!

Better off just not drinking and driving. Then you don't have to worry. I never got a DUI, but I should of many times when I was young. Now I never take a chance. In fact I don't even drink anymore. For now.

Exactly.

My daughters advice is to very calmly say: "Sir, I will not agree to any testing without my attorney present. I will abide by all of your directives...but I insist on my right to refuse field testing."

It never helps to argue...especially with the guy with the heater on his hip.

No one should ever argue with a law enforcement official...that is the job of an attorney...
 
I agree Prof. It does help to argue, but sometimes you have to tell the cop the way it is. Then off to jail we go.
