Gutted Cats

Yesterday a friend of mine in his 04 GT mustang was pulled over for loud exhaust. Officer pulled out a digital temp laser pointer and checked his cats. His was gutted. The temp was low. He got his car impounded. LA Sheriff patrols and he got told all So Cal Sheriffs will be checking if they have probable cause. He is trying to figure out how he can get it out of impound as it is not able to drive out. He can’t get it out they won’t let it be pushed of flat bedded out. They are being real arrogant about the whole situation. They do have the right due to cats being gutted but it almost looks like it he is being made a example.

I just got off the phone with him. He is going the Attorney route. He was told not to come back to the yard or they will call the police. It is kinda funny but it sucks.

He will be lucky if the don't fine him about $10,000- $50,000 for AQMD violations let alone the Federal violations for emission equipment tampering.

I have heard the Sheriffs' can impound a vehicle for a month. They can also fine you, take away the vehicle and or have it crushed with you watching

It is a federal violation to alter your exhaust system (delete the cats, gut them, or somehow compromise their purpose).

Since the car was impounded by a municipal authority this could happen:

The city could do whatever it is has on its books. Then the State could impose its penalties, and finally the Federal Government could then apply their sanctions.

Since these are different jurisdictions it is not a violation of the double jeopardy protections. This seldom happens but in the instances where an example is being made it has happened in the past.

The fact of the matter is that whey we (I hate that term, but it is appropriate here ) violate the law, it is possible that we will subject ourselves to the whims of those who enforce the laws.

I lived in California for four years while I was stationed there. Couldn't wait to get deployed or go on leave. Didn't look back after I left. That is one f'd up state. People are never nice. No courtesy ever. Granted, I never have been to the rural parts, but the crazy government overregulation extends there too. If you live there you might as well just sell whatever cool car you have and get a Prius.

Hopefully the attorney can help with this. I got the same thing done to mine, but I'm in Texas and they are strict, but not phucking laser temp reader strict, lol. He could go up there with a hack saw, and bracket a cheap Cat on then take it to a shop right then and get them welded or correctly done.

Have him buy a used stock mid pipe with factory cats. Take it there, jack up the car, remove the existing mid pipe with gutted cats and install the other totally stock mid pipe. Go on a Mustand forum, he should find a stock mid pipe with cats pretty easy and cheap........

Just near metro areas, but even then all they care about is speeding. We have loud crap all over here but no one cares. I've never heard of anyone being pulled over for being too loud, maybe for the bass being to loud, but not the actual car. The laser temp reader is still tripping me out. Hopefully I don't end up living out there because of my job.

He hired a attorney. He did not guarantee anything but to try to get him out of being fined. The car just had been smoged less than 1 year ago as it was now. He said did not mean anything as it could have been tampered with since then and the state would argue that fact. Looks like he will lose the ride as they will make the fines and impounds on so high it will get crushed. Lawyer at this point wants to try and protect him if possible.

I am going to Baja for spring break and won't know what happens Tuesday when he goes to court.
