got a scary person at my door today. and insurance fraud investigator.
back in 09 i hit something submerged in the water. about 45min before that i had gotten insurance. i have good proof of that. here is where the problem might be:
i filed the claim a few days after, giving the date of the 22nd as the date of accident. it was the 22nd. the insurance policy says effective date 24th. this is the first time i have realized the dates were different. if this is the case its just a misunderstanding. the guy from the insurance board kinda was curious on this one. he didn't know what to say and claimed this was not his case from thes get-go. so if the effective date is the 24th this case is over before it starts, if not i am fighting a fraud case, a felony. i really hope not, but if so i will go pro-per. honestly i have always wanted to be a lawyer, and i might get a chance to be my own. i know i am in the right, so not afraid of losing, however the guy assures me if they don't have a case he will not be charging me. so most likely this will be the last i see of them.
i was thinking the reason they denied my claim was because of only 45min lapse between the call to the insurance and the accident. its kinda funny in a way and kinda not. BUT i asked the woman on the phone when i started the policy if it was effective immediately and she said yes.
ok this begs the question of why wait till then to get the policy. frankly i forgot. meant to do it before i left. just before i went to see the statue of liberty at night did i remember. and only because i got nervous.
the damage was minimal. and was under 1200. not getting paid for it was not a big deal in my eyes. already fixed the prop that got damaged.
anyone have a similar experience? will update when i get the call and they say i am all set.
