Need some advise

Can someone tell me if I need to be worried???
My wife is doing a refi and I am not on the current loan as I was unemployed and going to a Trade School during our last Refi.
She is going to do a Refi with out me as part of the loan. I am still on the Home Deed as a Joint owner.
How would this Mortgage with only her work out if we were to Divorce at a later date???
It's od that she wants to do this against my wishes.
Marriage has been rough for sometime now.
Any input would be much appreciated.

Can She do that considering you are on the dee without you signung off on it ?????
 
My ex ,,got remarried and my name was still on the deed years after,,, She refinaced with my name still on the deed with her new husband---- it was illegal and the lawyer involved was dis-barred.... when she tried to do it agai 16 years later the title company said no way until I signed off on the house...Which I did , since I gave it to her to begin with.....This was in South carolina..
 
Hey if your thinking divorce, try to sell off everything you have slowly and put it into a offshore account that cant be touched by the US or sign everything over to your parents/brother etc.., And when it comes down to it you own nothing therefore she cant get anything.

Most state laws allow courts to go back 3 yrs to reverse just what you are saying to do...from a tax stand point you could also incur gift taxes (state & federal) by transferring ownership...

Hmm that sucks,, well if thats the case in your state, youll just have to take her on a fishing trip and use her for bait LOL...

This is IH8CHVY'S better half:
You don't need to worry as long as you are on Deed/Title to home. I do this alot for people for different reasons(credit, unemployment, etc..) It can be beneficial to you if something does go wrong. You are not responsible for the Mortgage pymt., But you own the home equally.
As long as you are on title it can never be re-financed without your agreement. You have to go to the closing Attorney and sign yourself out of title if you choose. If you don't want it refinanced, you don't sign and it cannot be done legally.
It also helps you if something happens and you need to qualify for your own home, this debt will not be counted against you, unless it is specified in a divorce that you must pay half.
We are in GA, but I would think property deed/title would be the same.
You could easily call a real estate Attorney in your state just to make sure before you sign off, because once you do that at a closing, she has to sign you back in to title:)

I agree with everything she says...but the above is the bottom line.
