Ticket today

On my way home today I got pulled over for speeding. I was following a ram QC and beside another ram QC, I know neither of them. The DPS officer pulled me over out of the 3 and I know I was going 80 mph in a 70. He asked me if I knew how fast I was going and I replied no. My issue was when I read the ticket and noticed this.

Violations Speeding - 10% above posted speed (#) same lane paced

Does this mean he clocked me with a radar or paced me? He said he clocked me and I never saw where he was parked. There is only one place for him to park on this stretch of the toll and its at the toll center next to the booth. This means that he had less than a mile between the booth and my exit, he pulled me over about half way there. The time on my toll stamps shows:

05/29/07 16:45 TEX.00201194 SH45N Heatherwilde Plaza L12 -0.68

This means he had 4 minutes to pull me over and write the ticket in a stretch less than a mile long. Im not sure how he could of paced me long enough to verify my speed. Here is a pic of the stretch that Im referring to:

Toll is in the upper right hand corner my exit is in the bottom left he pulled me over half way down. I know he came from the toll becuase I had just got on the Hwy and he wasnt behind me. This is my first ticket in 16 years of driving and the extra 5 miles over is $40. The ticket will be $8 for every mile over and $101 in court costs so. Should I even try to fight this one if this wasnt a radar check?

Hard luck man.. I would fight it... The record is clear that you don't speed
or haven't got caught speeding in over 16 years... i think you'll be fine :D

Nope he's saying he paced you. I guess that might hold up in Texas court, it might be worth going to court over. Most time cops are busy & dont even show up for court. Either way, always try & fight the law because you might WIN.
 
Hey, we have something in common, I was pulled over in my Hemi today as well.

I knew when he lit me up I was getting a ticket for something, but not speeding.

Pulled over for no front plate. Gave me a ticket for no seatbelt, let the plate go.

I am OK with it. I knew the law, I broke it. But these little ticky tack laws, well lets just say I have had two tickets for them in 18 years. It is not enough to "make me" change my ways.

It was a small town where watching the grass grow is entertainment, so the cops are bored. Hell, I live in a small town as well. Live a block from the police station and talk to the cops at the gas station at the end of my street often. They have even looked over my Viper while getting gas. They never "wondered" where my front plate was :dontknow:
 
Oh, and I would go to court on that one. The scanned image clearly states it was a pace type speed. That can be inaccurate and you should not have to pay for each MPH in that case. You may not get out of the ticket, but it should be reduced. Plea no contest (unless you KNOW you were not speeding) and explain why you feel it should be reduced.
 
both of the other trucks pulled out of the same parking lot I did. When he walked up to the truck the first thing he asked was what year model my truck was. Im sure it was loud as hell when I went by the booth and I didnt want him to start looking under the truck. I have my front plate on my visor so I pulled it down to get my insurance card which he never asked for.
 
Pacing? Pfft....right.
Unless he's a former Blue Angel, his number is probably off....by a lot.

I'd dress nice and take it court.
 
Hector Garcia??? Is that really the cops name or did you make that up? Yeah, the ticket says he paced you from the same lane. Your driving a red truck. He didn't even see the other trucks. Like a cape in front of a bull. Good luck with it.
 
pacing is the main method of catching speeders. you can't really fight it. It takes only a second to pace someone and get their speed.

also, as for cops not showing up to court - they got a new method now where your first court date is only to plead guilty or not guilty. if you plead not guilty, they will give you a new court date and the cop WILL be there.

According to the picture and description, the officer had less than 1 mile (5280 feet) to catch, pace, and record the offense.

Even with the badass rides the Texas troopers drive these days, I'm going with a "no chance" on this one.

I've heard of a person fighting and winning a speeding ticket that was paced.

What you can do is make them show proof that the speedometer of the car is calibrated (they prove this via a calibration certificate). Try and ask around or search the net to see if you can find any more info about that...
 
I think you are making a mountain out of a mole hill...one ticket in years and years? Hell send in the check and be done with it. I get a ticket every 5 or 6 years and consider them good therapy, and a reminder to pay closer attention to my driving. It's very dangerous out there, a ticket reminds me to slow down to 20 or so miles under the speed limit...its an old guys way of pissing off you flat-bellied, limber-backs!
 
Take it to a ticket CLINIC you wnt get any points on your license, you dont have to show up to court and its only $80.

thats what i have always done and my record is CLEAN.

Sure do, just to piss off you young dudes. I also move my seat all the way up so the steering wheel touches my chest, and I try to just peer over the top of the steering wheel...some say that my hair has turned blue too! But don't try to pass me, I will light 'em up just to keep you behind me...:D :D :D
 
Its principal on this one. I know by the sound of my exhaust when I am at 80 its loud as hell and I know within the time that he "could" of paced me I wasnt going 85. This wouldnt bother me had he not said the radar got you at 85. Now Im calling bs on his character since he lied then how do I know he didnt lie on the "pacing" I will ask that he show proof of the pacing all cars have video or at least show his time stamp on the toll road. The toll road has cameras he should be able to provide his following me? I have plenty of proof and if its needed can document it, can he. The court day is on or before 6-29 so I know where I will be at 9am. We dont have a points system in Texas and I have already taken defensive driving this year with my wife. She got a ticket a few months back and I took it along with her. We are allowed to do it once a year for dismissal or lower insurance rates. Its either pay or fight and I could use $220 toward plenty of other things.
 
I would go to court too! Hell, if you are gonna pay $100 in court fees, you might as well see what you are paying for!

I think you might have a chance on this one anyway.



And, ALWAYS WEAR YOUR SEATBELT!! Sheesh!! :D
