OK here is the deal. Judge elections are next month and my current judge is moving to a new county. Originally my lawyer was going to push the trial back from late this year to early next year. The problem with doing that is we would have a brand new judge and this will be his first case. So we are throwing out the idea of not pushing the trial because we know the judge we have now will give us a fair trial. So what do you guys think?


PS. You do not have to stay on topic, but at least every 5-8 posts should have some usefull info. Nevermind, do what you want.

That is where I'm leaning also. My other line of thought on this is that a new judge will be trying to set the tone for his remaining years. Kind of a tough on crime thing. I don't want someone to use me to make a name for themselves.

Very good point, often new judges feel they have to prove themselves. If you really feel that the current judge will be fair, I think that would be your best bet. It's a tough choice when you only know what one of the choices is, sort of like Let's Make a Deal. Is it worth the risk to find out what is behind that curtain?
 
Stay with this Judge Scotty......I have done the research on your current judge and I think you will get a fair shake :D You and I have spoke about this before...My mind has not changed as to what my opinion is on the subject :D
 
I would stay with the known quantity myself.

You could get some numbnuts and be screwed and there'd be nothing you could do about it later.

I just called my brother who's a praticing attorney... Has practiced all kinds of law....Marriage and family, criminal law etc etc.... He is current what is called "Gaurdian ad Leitum" (if that's even spelled correctly) for the State of Utah.

I posed Smoke's question to him...........

he said that there's no way anyone except maybe Smoke's lawyer could really answer that question with any degree of confidence. It's total crap shoot. Your lawyer should (and hopefully will) do his homework on both judges
in order to make a proper determination on whcih id the best course of action....

All any of us can do is guess.....and guesses don't mean shit....

You did research, I don't remember giving you the judges name.:confused: The research you did was it on the judge who's name starts with R?

True Tim and my lawyer is doing this, but she posed this problem to me to think about.

There is one other issue I didn't bring up. The State Attny (SA) who is handling my case right now is also leaving this year. He leaves like in Oct or so. This means that if I wait till next year for trial I will have a new judge and a new SA. Either way I will at least have a new SA by the time this goes to trial.
 
I agree, stay with what you know. New judges remind me of new police officers, not too mention even if the judge wasn't new, you still have the unknown of a judge you don't know. This is the worse case scenario because this new judge has no history for you to fall back on...

Just my 2 cents...

You know my thoughts Scott. We already talked about it. Good luck with what ever happens. We all know you are innocent, and the judge will too. Keep your head up man, we'ere all still behind you. (Just not like how Mikey is behind you...:D )

When you say you'll be getting a new judge, is he/she green or already a judge at a different location and just moving to your district? If he/she is brand new to the bench, they might have something to prove. If they're just relocated you'll have to look at their record and see if they're tough or lenient and compare their record to the current judge. Is it going to be a jury trial or just heard by the judge? All of us here are hoping it never gets that far and the charges will be dropped. Good luck.

i believe id go with the judge thats there now, never know what a new judge will do. if i can help let me know.

Election of judges. I don't know if they have prior history or not. Depends on who wins the election. This will be a jury trial (6 people).

I can't imagine how far your hands reach. One day you will have to tell me all the things I'm not seeing. I'm going to go ahead and say "Thank You" in advance. I'm need to email you a word doc also.
