While I see your point, I can see theirs as well. Each dealership is independantly owned. I'm sure DC could exert some kind of pressure, but really has no leagal way of dealing with it.
Good luck with this, it isn't going to be an easy road for you unless they do an about face in the face of leagal proceedings.

Park your truck in front of the dealership. Stand in the truck bed and hold signs that read "They sold me a wrecked truck and didn't tell me" or something like that. A good weekend of doing that will get some attention.

I gotta admit, if they keep giving you the brush off, I like this idea.
A local guy bought a Ford Ranger, and whatever the dealer did, it pissed him off enough that he painted (or used colored shoe polish) a HUGE lemon on the tailgate, and both doors. He also put some kind of lettering stating he was "Sold a Lemon by xxxxx Ford".
That was many years ago, and I still run into people around here that remember him driving around town with that truck!!
 
That is a real shitty situation that they have created. Smoke's idea isn't bad. Of course, part of me really likes the idea of parking it in the showroom too LOL. I think I would find another dealer in the area and see if they are interested in making a good name for themselves by taking care of this. You never know.
 
Thanks for the recommendations....according to FL law, they don't have to disclose anything under $500......first, good business is to disclose any damage period....second, it's my contention that getting the vehicle fixed so that you'd never detect damage is going to be much more than $500....third, how could you sell a damaged $40k, limited edition truck without disclosing this type of shyte....

Next step is to get three written estimates, contact the BBB, DMV, and local attny general.....all I wanted was to have this handled quickly and without legal hassels......looks like I may need to get an attny as well.....all this pisses me off....much more important shit in the world than to have to deal with this, but it's the principal that's kicking my butt and I gotta see this through....

Agreed. Wether its less than 500, it's listed as a new vehicle and should be delivered as such, not a damaged vehicle. Go for the throat, and good luck. Keep us informed...

Let me offer you another place to file a complaint. Go to the County Business License Office in the County the Dealership is located. Most county have some type of complaint system on their level so that they can close business that are not complying with state laws. Failure to Disclose the damage but qualify. If the county allows you to file the complaint, the county sends a letter to the owner(s) telling them of the complaint and of theri investigation. This will get their attention, also. For if the county fines them or suspends the business license, they cannot sell any cars.

They have been told to do this kind of crap(play dumb) in hopes you will just dissapear!! Don't, put the pressure on and don't let off, you will prevail!!

I had a similar problem with my Hemi. It was black. I picked it up in the rain. The first sunny sunny day i see a huge paint run under the clear and the rear passenger door that they had wiped with some solvent and recleared.

I had to break balls but I eventually got the dealership to fix the problem...your taking all the right steps now.

Appointments to get three estimates tomorrow morning to find out the extent of the damage....if all 3 are above $500, will get an attourney.....if anyone local to the Jax area has one they could recommend, that would be appreciated....

Marc, I'd rather not mention the name, but I will say that they are on the west side of town......that should help ;-)

Here in Arizona there is a law that requires that a dealership disclose any and all damage to a new vehicle that was repaired above a certain limit. I seem to recall the limit was any damage over $100 must be disclosed to buyer. Failure to disclose such damage is grounds for dealer buy back including trade in allowance and fines.

It is true that you get more with sugar than vinegar but if your state has such a law and it was violated and the damage was not disclosed to you upon purchase than I would pursue it fully to the extent the law allows

Personally, I would pursue it anyway in hopes that a reputable dealership will see the goodwill benefit out of taking care of it rather than call a tv channel consumer help advocate that will investigate it. The report it via the 6:00 news to the whole area. That happens from time to time in Phoenix - much to the chagrin of those "found out". I, for one, would not by a vehicle from a dealer that made the 6:00 news for anything.

I had problem with a dealer one time, that they would not resolve (they sold me a vehicle that had previous been wrecked and was in a rental!!) even though I asked them if it had been wrecked and ever a rental car. I had a TV station here in Phoenix all ready to do a story on it.. then they figured out that the dealer was a huge advertiser on their station and quickly backed off.
