i quit WoW 6 months ago, so this downtime before bed kills me now, going to get a wii next month......

they were in one lane, not moving. he did not move until after i had been stopped for a short time... maybe 15 seconds. when he hit me i was stopped.
when i was stopped i saw him starting to move forward. the truck in front of him, had not moved at all.
he could see me clearly, as i could see him looking at me. he could see me before he hit me. he could see me when he was stopped.
i can't be anymore clear than that.

And im pretty sure he didnt just see you get in his lane and decide he wants to dent your door up for you.

like i said, no way he didn't see me.
can someone be so into a conversation on the phone to look right at someone and not see them? if so then maybe he didn't notice me. i did notice that his expression didn't change. it was like an intense stare. and once he made contact all i could see was mack.

i wonder how long he had been driving that day? i am still digesting this whole thing, only happened at about 5:30.

Why didnt the cops issue tickets?
 
good question. one i cannot answer.

i can however speculate.

a good friend of mine who is a cop explained point of view and differing stories to me.

two people seeing the exact same thing might see it completely different.
this PoV can be skewed by a large number of things including their relation to that particular PoV.

in the case of "crashes" as they are nowadays referred to, it is very rare to have two parties in agreement on what happened. he said personally he take both sides, weights them and in the middle is the truth. not that the people are intentionally lying, although people can, will, and do lie, its generally not the case.
the way to error check is to have two police question two different parties twice or more likely, ask both party's the same question's rephrased different to see if anything changes.

in my case with this crash, we may have been 180 out from each other, and him, thinking he might never know the truth, gave up and wrote no one for anything.

another important part of a crash is contact point. that can say allot, and is one reason if i cant find a door for $100 or less and throw it on, it might help me.

if i just barely cut him off he would have hit the front half of the car. as you can see from the damage, he hit the last 40% and pushed himself forward onto my car. first contact point was just behind the door. the insurance company would look at that combined with the officers report to come to a decision of fault.

lets look at two opposite sides.

what if he was moving and i cut directly in front of him, as his story might have been:
the contact would be farther forward.

they would ask:
did he have time to stop?
could he avoid it?
do the marks go backwards and away? this would hint that he saw me and braked.

the obverse would be true if my story was true. the Point of Impact is too far rear to promote another story.

they would ask me:
was there enough room for me to pull in front of him? YES
was he moving at the time i changed lanes? NO
was i moving when he hit me? NO

sorry its hard to go beyond what i just said, let the barrage of questions and the few childish remarks commence.

actually if i didn't hate public speaking so much i would be a lawyer.
my brain soaks up information, anything i read and care about or hear and care about i remember, that's why i can't spell but i know there were a total of 1269 red 2004 trucks like mine made. lol.

last i checked there were 8, and out of 8 there are only 4 that you could walk on if you could tolerate the environment. the others are gas balls.
