i got arrested for what you may ask?

OK, ok. The guy was a jerk. I am a police officer, have been for 10 years. I just sold the 10 to, you guessed it, another police officer. Most of us are normal guys who love hot rods, motorcycles and women. But there are some that just love power and authority. Rest at ease that his co-workers also view him as a complete a-hole and he doesn't get invited to any parties. We all know em. We all hate em.

I have gotten tickets like this nollied numerous times. Before you spend money on a retainer I would call the prosecuting attorney with jurisdiction over the citation/arrest. Most of the time, if you have a clean driving record, they will reduce it to a non-moving violation.

Although he was completely within his rights to make an arrest it was obviously excessive. And for those screaming Miranda; you only have to give Miranda if the suspect is questioned about elements of the crime he was arrested for while in custody. Doesn't seem to be the case here.

Wish we could say this doesn't happen or won't again but it will. Just be cautious about where and when you play.

Thanks for what you are willing to do for all of us.

Sworn officers are the core of what this country wants and needs to be, with only a few exceptions.

I lit up the tires once when I got my stage 2. The cop was at a gas station and I never saw him. He ran me down as I turned off the main street. I never exceed the speed limit and there was no traffic on the road. After he checks my papers he asked what my plate meant. I knew then I was not getting a ticket. Sorry to hear you got locked up.

Except San Bernardino County:mad: There are more Fed's investigating Wrong doings by the County and local Sheriffs than there are in the department.:(

We live with absolute corruption Every day :argh: :argh:

Did he read you your Miranda Rights? If not, it usually gets thrown out of court. ;)

FYI: Since driving is considered a privilege and not a right, Maranda does not apply to traffic offences.

.

Sorry for all the problems bro, but from the sounds of our knowledgable members sounds like things will work out for the good, except for the saddness of your wife, tell her we are all sorry:eek: and then let her spank you as punishment:D

but to all the honorable law enforcement reading, thanks for all you do, everyday:rock:    its an honor to know that there is still good left in the world today:congrats:

I had the same thing happen but I wasn't arrested I took of at the Light chirped first and second and stayed at the 45mph this prick comes flying around the light whipped a turn and came after me but in Illinois most cops have cameras and are voice recorded once they make a stop he tried to get me for speeding and reckless driving put I asked him to see the gun, then He said he seen me take off but that was it, I asked him if there was a law for getting to the speed limit as fast as you can and he said no with a pissed off look on his face and said have a nice day. Lawyer up you'll beat it plus the lawyer will keep your rates from going up. Just another way for them to make money out here if you get pinched for 10 over 150 bucks plus court costs 15 mph over they can charge you up too 100 for every mile over the speed limit.
Also don't get a lawyer the judges hate I did that once, needless to say that fucker hammered me because of the lawyer so get a lawyer but just be carefull who you get cheaper Is never better in the court of law.

taking a ride in the srt i pulled out onto the highway straighten the beast out and punched it from a 15mph role. the tires lit up and powershifted second same results then to 6th to start my journey to the local sonic. :marchmellow: keep in mind all was done to the speed limit not over. Im driving now for 2miles and a trooper comes lights blazing so i pull over into a stop in go. I figure ahh another ticket. I start rolling down my window and i notice he goes for the handle (doors locked) so i open the door i get let me get my insurance out of my wallet and he grabs my arm pulls out of the truck spins me around and slaps the chains on me. Your under arrest for wreckless driving. i had nothing to say i was in shock. wife was left crying and no clue how to get home. whats your thoughts?

im real interested were you got the ticket what part of houston was his station located at ??and what judge do you have to appear before

Who is this miranda? and what is the right she has:dontknow:

they always just cuffed me , slung my butt over the hood, and talked to me the next morn:D

Miranda is actually a man....he kidnapped and raped a woman back in 1968 if I remember correctly....he appealed his conviction due to not knowing his right to keep his mouth shut....the ruling gave birth to the Miranda warning.."you have the right to....."..............Justice was served on the slug later. He was killed in a knife fight and his killer was read his Miranda warning...;)

sweet! thanks! learn something new every day:rock:

We push the "RED" button we take our chances. Sometimes we get caught. If we're lucky we we find a way out. If not we get hurt in the pocket book. Sorry for your predicament and good luck. Been there done that more than once.

Miranda is not a requirement for an arrest to be made. I never gave the Miranda warning unless there was a major crime where questioning was needed to resolve it. My knowledge of this comes from being a graduate of the TN Law Enforcement Academy and BS degree in criminal justice. An officer may give the Miranda warning in all arrests as a CYA but not as a requirement.

Here ya go... :dontknow:

Berkemer v. McCarthy US Supreme Court 468 U.S. 420 1984

Sorry, TN. But, I'm a little jaded on this subject. I fought this very issue in court for a street-racing charge. I won it, BTW. Not trying to step on anyone's toes here, just letting everyone know their rights as prescribed by law and the constitution.

Thanks Jake:congrats: , It is amazing to me just how much the "Officer's" do not know about the laws they are sworn to uphold.:(
Maybe some refresher courses should be in order:rock:  :argh:

Not sure if it's all that, D. The police run on a pretty tight budget, mostly (unless they are LAPD or NYPD, or those "Mega-Dept's"). They really don't have the funds to re-train all of the officers, and pay them well (which, sadly, they don't do that most of the time). They just run off of what "works" I guess. ...... It's sad too, because LOTS of hard work (and money) is lost when the case goes to court and the defendant gets off on a technicality (like Miranda, illegal search/seizure, etc). The cops get caught being retro-active, instead of pro-active most of the time... and that's too bad. :(

I am one of the lucky ones, I guess... I've never met a "ass-hole" cop. Just a bunch of regular guys (and gals) trying to make a living in a thank-less, dangerous job.

Me too.

I would not have the job no matter what the pay...I thank God that there are people who love to do it...it is a thank-less, dangerous, and emotionally taxing profession.

Jake are you in MI?

Oh, they do have plenty of revenue to buy armored vehicles, machineguns,
( to shoot Mayors and citizens dogs during bogis Raids),lots of new patrol cars, computers, donations from the Feds for the "War on Crime",and new traffic cameras( the city of Victorville nets $1,000,000 + a month with these BTW) so I do not believe there is a Money problem, just a bad attitude problem with the new generation of (verses previosly respected officers) Jack Booted Thug Police officers we have today:mad:

I really want to thank everyone for the advice, i did talk to a lawyer and he said he can get it reduced to "unsafe start from a stop" so maybe i can take defensive driving so it wont go on my semi clean record.

Just a warning to all those around texas when going down hwy 6 in santa fe ,alvin, hitch cock those cops will pull you over for anything they have made headlines in papers and still will not stop there bullshit.

All this caused by testing my new jmb intake. i hope that dude is happy.
