One Less 10

Thanks everyone for chiming in. There are many legal fine tooth issues for sure and I am working with a lawyer now on that part, so won't be able to talk about those details so much at the moment. But the options in that lane are more favorable than I thought I had before.

I know at root of it all, dealers are a business, and I respect that, but how they value and treat customers really says a lot about their character.

truth is, we probably don't have all the facts, and if, and it appears that there is, some legal ramifications to this, then the actual parties involved can't discuss it anyways.

i did ask from the beginning why the OP's insurance wasn't covering it, or the driver.

i've wrecked other people's cars before, and the insurance companies on both parties will be involved. the coverage follows the vehicle, and most likely if it becomes a legal situation, the driver's insurance will actually repay the vehicle's insurer... so, for example, i get points on my license, my insurance goes up, but initially the vehicle owner's insurance pays for the damages, and most likely sues my insurance company for the amount (or whatever happens behind closed doors that we don't know about)... based on my experience, anyways...

i'm not holding the dealership at fault, just curious as to why there's a question in the first place of who has to pay...

at the end of the day, what doesn't sit well is an employee drove SOMEBODY's truck while he was on the clock... that's the only reason to involve the dealership that i can see... but i don't work at one, either and i'm sure there's a lot that i don't know about it...

either way, i don't have a dog in the fight, or want any parts, so... i'm going to go get lunch... in my truck :D (no offense, bryan:D :D :D)

The employee drove a truck that was under that employee's care. It is exactly the same as if he drove a buddy's truck to work, then crashed it while driving it at lunch. The dealership is totally not involved and not at fault.

The very idea that my employer is in any way responsible for what I do on my lunch hour is socialistic.

Get a flatbead trailer, put the truck on it and park out front of the dealership "on the public street" with a sign that says, lets talk about customer service and their service department. If asked to leave by the police, comply without arguement. Take pictures of the truck and use social media, it's amazing the coverage you will get in the local area. Don't be mean, let your truck sway opinion. I guarantee you, their lawyers have already decided you loose, if you can get sales to drop, your voice has been heard. There bean counters have done there part, you need more beans on your side of the ledger. Just maybe, they will offer a cash settlement, let them do it

I share your loss. It was last year this time when I put a piston through my block, and that wasn't even getting on it. Guess the SC was too much! I was able to rebuild, fortunately, and make better. To cheer you up, that was 25k out of MY pocket...no insurance covers that.....

lol, i would want to know what my employees were doin while on my clock, no?

So let me get this straight, you think that if I am working for you, and I take a friends truck for a joyride while on the clock, and crash it, that you as my employer are responsible for the accident?
