Hey folks.
A company knocked on our door a few weeks ago asking if we'd like to pay them to remove (3) dead trees from our yard (1 in front; 2 in back). Rachel and I consulted and agreed. Price quote- with stump removal: $250 for all 3 trees.

About a week later (5.15.07), the workers arrive. Of course, they arrive while I'm not at the house and begin work (there was a note on the front door that I would be back in 10 minutes from my post office run).

What did I miss? Well, when they took the first dead tree down, it apparently fell toward the driveway and crushed one of the 14' juniper trees that line our driveway. I noticed a couple of small branches had fallen of of one of the junipers, but took it as "collateral damage" from the tree they cut down. I did not think much of it, and did not say anything to the workers...nor did they say anything to me.

The stump guy pulled up and said, "I can take those stumps out for you for $20 each." I asked the head tree guy, "Your quote included stump removal, and he wants to charge me for it. WTF?"
"Stump removal is through another company...."
"Fine. Just f-ing do it."
Nice bait & switch.

They finish the job and get check from me for $250.00.
I paid cash to the stump con man.

Today I'm adding fertilizer spikes to all the juniper trees and bushes in our yard (about 50 of them in total). I notice that the juniper that had a few branches knocked off of it that day is now dying. The whole side opposite the driveway is orange/brown.

I also noticed the huge roll of 18 ga. yellow wire they used to tie the two stalks of the juniper back together in an attempt to prop it up. To say they left a little extra wire would be a big understatement. They probably left me about 50'.

The juniper is seriously damaged and I'm not sure I can save it.

To replace that juniper would be about $300-400. 14-footers don't come cheap.
I don't think it can be replaced because of it's proximity to the concrete driveway; the 'tree digger' wouldn't be able to remove the old one or put the new one in w/o taking a huge chunk of concrete with it.
The damaged juniper is in the middle of the row. Taking it out and leaving a bare space is not an option.

I called the tree care company today and talked to the owner. I left my info and he said he'd be coming by to check out the damage.

Any suggestions or ideas are welcome.

Since you took pic's I say make them replace it...It's their fault Kevan..... Juniper are very delicate and it will never be the same again unfortunately. They do not recover well from trauma....Post me a pic and I will consult with the tree Guru at work, but if my past experiences with Juniper tells me anything....It's never going to recover.
 
Kevan , First off how big were these trees cut down. 250 for three trees sounds like aprice you would get from a local handyman. At least in my area.
For one 30 foot tree with16" stump cost $2000
As far as collateral damage goes, thats the reson why you hire contractors who are reputable and have LICENSE and INSURANCE.All states are different
I don't know the law in OH, but here in NY you can pursue something like that
and bring to resolution throuh Dept ofConsumer Affairs

Steve- the tree that damaged the junipers was about 25'-30', and approx 8" in diameter. It wasn't very large, but it was very dead.
The "contract" I have on my desk states nothing about 'collateral damage' or anything other than "Work To Be Performed" and how if I add to the order additional charges will apply. There is no disclaimer or legal info on the contract.
 
Small contracts do not neccesarily go into detail about collateral damage , its more or less understood. If you found some damage you should have confronted them about it on the spot. If they're reputable people I'm sure they would have made good on a small claim. If its a big claim thats where their
liability insurance would kick in ( if they have any) Whats the damage estimate?
 
Not sure on the damage estimate, but it won't be pretty. A new tree will be $300-400, the tree spade will have to get past the concrete of the driveway, so that would need to be torn up and re-laid.

Like I said: not pretty.
 
I say either cut the yellow branches and be done with it, or leave it and be done with it. Sounds like 250 was a great deal to remove the trees....

Yep, they fell that tree right on top of that poor Juniper..... Bunch of amatures. :mad: :(

Too bad.... That was a pretty tree. :dontknow: :( ....... Hope they replace it for ya, Kevan. But, as Red said, it was a DAMN good deal for removal. :confused:

Not a bad idea, but I won't do it. I will not have my house/yard looking like crap.
The homeowners association will have a fit too.

UPDATE:
I just measured the damaged juniper. It is NOT 14' tall.
It's 13' 2".
My apologies.
 
Call the company and request the owner to show up to look at the damage his workers caused. Tell the owner your are not satisfied with their work and ask him for his opinion as to what should be done. If the owner of the company has any backbone he will offer to repair the problem at his own expense.
 
I would hope for that, but it won't happen.

The only way to replace that juniper tree would be to cut up the concrete in the driveway (half the roots are under the driveway & the new tree needs a hole with clearance), tree spade the old one out, tree spade the new one in, then re-do the concrete in the driveway.

Chances of him doing that: F'ING slim....backbone or not.

If you use this on the culprit tree and then skip a tree and spray a tree going in both directions, your problems will be solved, it will be symetrical and your lawn will get added growth from the sun. Also, in 10 years you won't have to replace your driveway because the roots have upheaved it. You may want to try some PVC root guard panels they keep the roots from going under the driveway and lifting it. Just a thought. If you don't like this one, then throw some tires on your roof and no one will ever notice that yellow branch on your tree ;) ;) :p :p :p :p :p :dontknow: :dontknow: BUT check your CC&R's first, it may be against your HOA rules :star: :dancing:
