Warrenty Problem - Advice!?

So my tranny gave out on me, and I thought I'd be covered under my extended warrenty package.

I was driving normally and heard some weird noises coming from the tranny. I played around with the gears (2nd - 5th) and everything seemed to shift okay. I came to a stop sign and down shifted into first. I couldn't get it into gear, it was grinding and wouldnt let me in. I played with all other gears and everything seemed normal. I took off in second gear with no problems. I finally was able to get it in 1st gear, but as soon as i started moving it would pop out.

I took it to a shop and they got the go ahead to pull it apart. It turns out I was missing a plastic clip on the 1-2 shift fork. He said this stopped 1st gear to fully engage and caused it to pop out. Now 1st gear teeth or a little bit warn, and they wanted to replace it. So they were going to do a rebuild and replace 1st gear. Warranty sent an adjuster over to take pictures as it was an expensive bill. They were pissed because they wanted to replace so many 'wear items' - but the shop said they have to warrenty the tranny for a year so thats why they were replacing other parts. They denied my claim "due to misuse". They kept telling me the teeth were chipped on first gear, and I was power shifting and slamming gears. 2nd, 3rd, 4th, 5th, 6th gear I guess that may makes sense, but i dont know how a guy could power shift first!? And what really bugs me is the guy at the tranny shop said the transmission would function replacing the clips on 1-2 shift fork, and leaving the gears as is. But he said they have to replace the gear because they have to warranty the transmission. I went down there and looked at the gears and they are not chipped, simply warn. he said due to it popping out of gear.

So now I don't know what to do. I've heard of these clips breaking before. And I don't know how the truck was previously treated, but I bought it with 9300 miles and put on a couple thousand miles. Are these clips just a wear item? Or did something have to break them. If I was beating the hell out of the tranny i'd bite the bullet and deal with it... it's just the fact that I was driving perfectly normal when it happened, and have never been hard on that tranny.

Any advice guys? I'm willing to take legal action, I think this is BS. They cant prove it was misuse... i'm sure it looks like it could of been from misuse, but the fact that that clip was missing shows that that was the initial problem and then popping out of gear caused the excessive wear. And he didn't say the clip broke because of misuse, he kept saying the teeth were chipped and thats how they know.

What do you guys think!? :mad:
 
Anybody? I have to get this straightened out asap. Trucks been in the shop for 2 weeks, haven't even got parts yet. They say parts alone are touching 4 grand - dealer items only. Where else could a guy look for rebuild kits/gears?
 
Is this an aftermarket warranty or a factory extended warranty?....aftermarket vary a lot while the extended warranties by the mfg are more apt to pay off...read your warranty...talk to an attorney....nobody here will be able to give you competent advise if they havent read the warranty and understand it.........:dontknow:

Another fabulous plastic fork pad problem.

If you had a bad plastic pad causing it to not go into gear far enough you will need both a gear and syncro.

I went through the same thing, but my warranty was denied because I imported the truck into Canada from the US.

Now you have a chance to build it stronger, make sure you get the bronze fork pads for all gears including reverse.

Damn I just read this 4k is freakin ridiculous. I got my rebuild kit from Six Speeds Inc, but I think they went out of business. I bought a stage 5 kit and a bunch of other stuff for under 2K. Get your shit out of the dealer and have someone else do it.
 
give me a shout buddy , I know about a kit that you can get with gears fork pads and all , and for about well jsut send me a pm cuz I aint sure:D
 
It's a 3rd party warranty. Paid 2500 dollars for it. And it's in a shop, not dealer. i think i'll just try to get my money back and put it towards the rebuild. Labour is not bad just the parts here in canada are extremely expensive, from where ive looked anyways.

Do you know off hand where I could find info of anyone else having this problem? Might help me out a bit convincing these guys thats what caused the failure.
 
You guys are awesome, much appreciated. I'll talk to the shop and see what we can work out. The ten is covered in dust... it's a sad sight.

There are good 3rd party warranties but unfortunely there are more rip offs...talk to an attorney before rolling over....

Its been on here a few times. I think way more have failed than we know about. Most people dont take apart there own stuff and have others do it for them. Then they never really truly know what did fail. Why else would these aftermarket companies offer a bronze pad kit? Its because it is a problem.

I had reverse fail on mine.

Where are you in Canada?
 
Where are you located? Maybe we can recommend a shop for you.
 
Regina, Saskatchewan. just brought the truck up from Illinois. Put only about 1000 miles on the thing.

Trannys already in peices... I figure if i can get a kit for cheap they'll just handle the labour. No sence in hauling it to another shop.
